Rajasthan High Court's decision upheld: Giving this decision, the Supreme Court dismissed the appeal of Bharat Sanchar Nigam Limited (BSNL). Which he had filed against the decision of the Rajasthan High Court. A bench of Justices MR Shah and BV Nagarathna in its judgment on Thursday said that a reserved category person can claim a seat in the unreserved category if he comes on top in merit. The seat vacated by his being selected in the general category will be filled on the basis of merit from the reserved category only. BSNL appealed in this matter.

What's the matter


Rajasthan Circle of BSNL had invited applications for the post of Telecom Technical Assistant. In the examination held in this, many OBC candidates scored more marks than the last candidate of general category, but they were selected at the top of the reserved ones. Sandeep Chaudhary of OBC category turned to CAT on this. Said that such OBC candidates, who have scored more marks than normal, should be considered in the general category, due to which the list of OBCs should not be disorganized. CAT considered this to be correct and ordered Choudhary to be selected in the OBC category.


Challenged the decision


CAT said, OBC candidates, whose merit is higher, if they are accommodated in the general category, then the OBC seat vacated by it will be filled by the remaining OBC candidates. BSNL challenged this decision in the Rajasthan High Court, but the High Court dismissed the petition.
