Latest Updated 06/08/2024: Patna High Court has sought a reply from the state government and Bihar Technical Service Commission in the matter of giving 10 percent reservation to economically weaker sections of upper castes on total unreserved posts. The court has ordered to clarify the situation by filing a counter affidavit within four weeks. A division bench of Chief Justice Justice K Vinod Chandran and Justice Nani Tangi heard the petition filed by Ajay Kumar Lal and others on Monday.
Senior advocate DK Sinha and advocate Rakesh Kumar Sharma, on behalf of the applicants, told the court that the state government is giving 10 percent reservation to the candidates of economically weaker sections of upper castes on total unreserved posts. Whereas there is a law to give 10 percent reservation to economically weaker sections out of 50 percent unreserved posts. Challenging the government's rule 4, he said that when 10 percent reservation has to be given, then how can anyone give 10 percent reservation in total posts. He demanded the court to cancel this rule.
On the other hand, the government said that the law of giving 10 percent reservation to the economically weaker sections is correct. This law was brought in 2019. Since then it is in force in the state. EWS candidates who are selected on the basis of their merit are counted in the direct recruitment category.
