Education Department gave instructions to all the District Magistrates

Latest Updated 06/02/2024: The Education Department has given the strict instructions on the announcement made by employed teachers to protest against the competency test. The department has instructed the District Magistrates to take the other action including registering a FIR against such teachers.


The department has said in a letter to the District Magistrates that as per the information received, the employed teachers have announced to boycott the competency test and demonstrate in front of the Assembly on 13 February. Schools are open on 13th February. In such a situation, if teachers leave the school and join the protest, it will be clear that they are creating obstruction in the teaching work in the schools. If any kind of protest program is organized by the teachers employed in your district, then consider it as an illegal assembly under Section 141 of the IPC and take necessary action. Also, an FIR should be registered under sections 186, 187 & other relevant sections of the IPC. Also, the teachers participating in such protests should be identified and strict disciplinary action should be taken against them in the light of departmental rules. Online applications are being invited for examination


Online applications are being taken from the teachers for the competency test. The examination will start from 26th February. Competency test is being conducted for 3.5 lakh employed teachers of the state to give them the status of government employees. Those who pass the examination will be state employees and will be called special teachers. Every teacher will be given three chances to pass the examination. It has been decided to terminate the services of teachers who passed the examination on all three occasions.


Teacher will have to fill the option of three districts


Every teacher is also being asked to choose three districts to appear in the competency test. On the basis of merit list prepared after the examination, teachers will be allotted schools in the choice district. Special teachers will be given pay scale and other facilities on the lines of teachers selected through Bihar Public Service Commission. Besides, they will also be given the benefit of salary protection.


Competency test rules challenged in High Court


Teacher Competency Test Rules have been challenged in the Patna High Court. This application has been filed to declare Rules 3 and 4 of Bihar School Special Teacher Rules, 2023 as illegal, discriminatory, unfair and against Articles 14 and 16 of the Constitution. In the petition, the court has been requested to ban the filling of applications for the examination. Besides, a request has also been made through the petition to ban the examination to be held from 26th February. Senior advocate Yogesh Chandra Verma, appearing for the applicant, said that this is against the rules.
