Latest Updated 10/10/2023: At present, the Bihar government has not got relief from the Supreme Court on the issue of appointment of teachers to teach children from class 1 to 5 in government schools. The apex court refused to accept the govt's demand to allow B.Ed degree holders to be recruited as primary teachers in the ongoing teacher recruitment process in the state. This government withdrew its petition.

The petition of Bihar govt was to be heard before the bench of Justice AS Bopanna & Justice MM Sundaresh. The bench referred the matter to Chief Justice so that it can be listed for hearing before a bench led by Justice Aniruddha Bose. Justice Bose had said in the judgment on 11 August that those with B.Ed degree cannot be recruited as teachers in primary schools. The notification of NCTE, which had asked to include B.Ed candidates in the recruitment of primary teachers in the states, was cancelled.
