Latest Updated 29/08/2023: The Supreme Court said on Monday that by adding Article-35A to the Constitution for Jammu and Kashmir, three fundamental rights of the people were taken away. Due to the special rights given to the permanent residents of the state, the rights of people from other parts of the country to get employment, buy land and settle there were violated.


The apex court made this remark during the 11th day hearing on the petitions filed against the removal of Article-370 from Jammu and Kashmir. Chief Justice D.Y. Chandrachud said that equal opportunities for all citizens in getting employment in the state, right to own immovable property comes under the category of fundamental rights under the state government. He said that Article-35A snatches all these rights from the people, because these were special rights for the citizens of Jammu and Kashmir.

At the same time, Solicitor General Tushar Mehta said that after the removal of Article-35A, the state is developing, investments are coming on a large scale. There is an increase in the tourism sector. The people of Jammu and Kashmir are also getting the benefits of those schemes which the people of other parts of the country are getting.
