Junior engineers will be reinstated by making new rules, the court, approving the government affidavit, ordered to publish a fresh recruitment advertisement

Latest Updated 17/02/2023: The Patna High Court on Thursday heard together eight petitions challenging the rules laid down for the recruitment of 6379 Junior Engineers. Regarding the reinstatement rule, the court was told by filing an affidavit on behalf of the state government that the government has withdrawn the reinstatement advertisement. The advertisement will be taken out again after making new rules.


A division bench of Justice PB Bajantri and Justice Arun Kumar Jha heard the application filed on behalf of seven others including Sanjay Kumar Chauhan. On behalf of the applicants, Advocate SS Sundaram and Advocates Dinu Kumar and Ritika Rani told the court that the educational qualification given in the published advertisement is legally incorrect. Not only this, it is also against the decision of the Supreme Court. He said that the advertisement for participating in the reinstatement of pass students from AICTE approved diploma institutes has been published in 2019. While state govt recognized diploma institutes including Deemed University have to take recognition by UGC instead of AICTE. As a rule, it is not compulsory to take recognition by AICTE for Diploma.

In the light of the arguments presented by the applicants and the decision of the Supreme Court, the state government filed an affidavit in the High Court and told the court that a fresh advertisement for recruitment of Junior Engineer would be published by altering the recruitment rules. Accepting the affidavit filed by the state government, the court executed all the petitions by changing the restoration rules and ordering them to publish the restoration advertisement afresh. It is noteworthy that in 2019, the Bihar Technical Service Commission had issued an advertisement for the recruitment of 6379 Junior Engineer.


Patna AIIMS ordered to file affidavit


The Patna High Court heard the matter of investigation and treatment of three economically weak and physically challenged girls of Sitamarhi district. During the hearing on Thursday, a division bench of Acting Chief Justice Justice Chakradhari Sharan Singh and Justice Madhuresh Prasad ordered the advocate of Patna AIIMS to file an affidavit and give complete information.


AIIMS Patna's advocate Vinay Kumar Pandey told the court that out of three girls, two have bone related diseases. His treatment has started at AIIMS, Patna. About three lakh sixty thousand rupees will be spent on the treatment of these two girls.


Prohibition on examination result of assistant professor reinstatement


The Patna High Court on Thursday stayed the result of the examination held for the reinstatement of the post of Assistant Professor of Psychology. A single bench of Justice Sanjeev Prakash Sharma stayed the result after hearing the application filed by Vasundhara Raj and Sangeeta Kumari. Advocate Chandrashekhar Singh, on behalf of the applicant, told the court that the backward class candidates have been put in the unreserved category. He said that the reservation rules have been implemented arbitrarily. The result is being prepared by putting backward class candidates in unreserved category. For the time being, the court stayed the declaration of the result.
