On March 1, the single bench of the High Court had ordered the reinstatement of ANM on the basis of marks instead of written examination. The state government has challenged the validity of this order by filing an appeal.

A division bench of Chief Justice K Vinod Chandran and Justice Harish Kumar heard half a dozen appeals filed by the government on Friday. The court has refused the government to release the results at present. The Advocate General presented the case on behalf of the government. The court issued notices to all the defendants in these cases. Also, the date of final hearing on the case was fixed as 2 April.

Written examination was held on March 1 for appointment to 10709 ANM posts

It is noteworthy that on March 1, the single bench of Justice Mohit Kumar Shah had ordered the reinstatement of 10,709 ANMs on the basis of marks. In its 69-page order, the court, while canceling the notice of Bihar Technical Service Commission dated September 19, 2023, had said that the reinstatement of ANM will be under Rule 7 of Bihar Female Health Worker (ANM) Cadre Rules 2018.


Advertisement for reinstatement was released in 2022: Let us tell you that on the orders of the High Court, the government had published advertisement number 07/2022 for reinstatement on 10,709 ANM posts in the state. After which the selection process was started under ANM Rules 2018. Meanwhile, the state government amended the rules and issued rules for reinstatement on the basis of written examination instead of marks. The validity of this notice was challenged by filing a writ petition in the High Court. The court heard all the petitions together. Advocate Arun Kumar, on behalf of the applicants, had told the court that an advertisement had been published for the reinstatement of 10709 ANMs in the state in the year 2022.


According to this, 60 marks were fixed for ANM course examination, 15 marks for higher course and 5 marks (maximum 25 marks) for each year of working in a government hospital of the state. But the state government abolished the reinstatement rule and added a new rule. According to which, 60 marks were fixed for competitive examination, 15 marks for higher course and 5 marks (maximum 25 marks) for each year of experience of working in a state government hospital. The responsibility of conducting the written examination was given to Bihar Technical Service Commission. The new rule was implemented from June 1, 2023.


Case of giving job on compassionate grounds postponed for 24 years, fine


The High Court has expressed strong displeasure over keeping the case of giving jobs on compassionate grounds pending for 24 years. The court imposed a fine of Rs 3 lakh on the government and ordered to pay the money within three months. However, the court refused to give the job on compassionate grounds. A division bench of Justice PB Bajanthri and Justice Alok Kumar Pandey heard Mangal Bahadur's application. Applicant's lawyer Deepp Jha said that after the death of the applicant's father in 1992, the application for appointment on compassionate grounds was given in 1995 along with all the documents.
