No relief from Patna High Court for 22000 primary teachers holding BEd degree under Bihar government latest news update 2023



Latest Updated 07/12/2023: Clouds of crisis are looming over the jobs of about 22 thousand teachers appointed on B.Ed degree in primary schools under the state government. Patna High Court has not given any relief to the teachers of class 1st to 5th.

The court said that under Article 141 of the Constitution, the High Court has to accept the decision of the Supreme Court. In such a situation, B.Ed degree holders are not eligible to be appointed to the post of teachers in primary schools.

A division bench of Chief Justice K Vinod Chandran and Justice Rajeev Roy delivered the verdict on Wednesday after simultaneously hearing three separate cases. The court declared the notification issued by NCTE (National Council of Teacher Education) on June 28, 2018 as wrong. In that, B.Ed degree holders were considered suitable to teach children from class 1st to 5th in primary schools. The validity of that notification of NCTE was challenged in the High Court. The High Court said that only D.El.Ed degree holders can be appointed as teachers in primary schools from class 1 to 5. After this the notification of NCTE was challenged in the Supreme Court.

The Supreme Court also canceled it. The apex court had clarified in the order that only teachers holding D.El.Ed degree can be appointed to teach in primary classes.

Now the post will have to be filled afresh


The High Court said that in the sixth phase of teacher appointment, B.Ed degree holders were appointed for classes 1 to 5. Now it will have to be filled afresh. The state government will have to make appointments only from among the eligible candidates as per the original notification issued by NCTE in 2010.
