Latest Updated 12/04/2023: The Patna High Court has upheld the single bench decision to set aside all the directions issued by the Bihar School Examination Board for depositing inspection fee and taking other action for the intermediate colleges of the state to seek re-affiliation. The court dismissed the appeal filed by the Bihar School Examination Board. A division bench of Chief Justice Justice K Vinod Chandran and Justice Madhuresh Prasad passed the order on Tuesday after hearing an appeal filed by the Bihar School Examination Board. However, the court has given complete freedom to the Bihar School Examination Board to inspect intermediate colleges.


It may be noted that on July 22 last year, a single bench of Justice Sanjeev Prakash Sharma, while hearing a petition filed by the Bihar Intermediate Teachers and Non-Teaching Employees Federation and others, quashed all the instructions issued by the Bihar School Examination Board. The decision of the single bench was challenged by filing an appeal to the Bihar School Examination Board.

The lawyer of the union said that when the government has given affiliation, then it is not legally correct to force them to take affiliation again and again. On the other hand, the court was told by the board that the board is doing all this to ensure that students get education in colleges with better resources. There are many intermediate colleges in the state which are severely short of resources. The court dismissed the appeal filed by rejecting every argument given by the board.


Affiliation was given after the investigation report of the colleges


Union's counsel Shashi Bhushan Singh told the court that a memo was issued by the Bihar School Examination Board on July 4, 2020, for re-affiliation to about 599 government-aided intermediate colleges in the state. He said that earlier under Section 39(2) of the Intermediate Council Act, affiliation was given to all intermediate colleges after inspection reports. On which the state government had also given its consent. Government was giving assistance to all affiliated intermediate colleges. From the year 2013, government funds were given on the basis of the performance of the students, but suddenly the board issued instructions to these colleges to seek affiliation again. Also directed to deposit inspection fees for affiliation. He said that the colleges which did not deposit the inspection fees for re-affiliation were not allowed by the board to enroll students in Intermediate. Because of this, intermediate colleges are on the verge of closure.
