Latest Updated On 13/07/2022: Patna High Court has set aside the instructions of the Bihar Board, in which all the inter colleges & the affiliated degree colleges offering inter education were asked to submit the inspection fee and take other action for taking affiliation. Along with this, orders have been provide to include the names of these colleges on the OFSS portal for admission in the Inter session 2022.

After this order of the Patna High Court, 138 inter colleges of the state will benefit. A single bench of Justice Sanjeev Prakash Sharma gave this order while hearing a writ petition filed by the affiliated Degree College or Institute Service Association & others. In fact, the Bihar Board had removed the names of these institutes from the OFSS portal for the 2nd time due to not applying for affiliation on time. After this, a case was filled in the Patna High Court by the Bihar Intermediate Teachers & Non-Teaching Employees Federation. Along with the affiliated Degree College Service Association, many colleges had also filled a petition.

Senior advocate PK Shahi & advocate Shashi Bhushan Singh, appearing for the applicants, told the court that the Bihar School Examination Committee had issued a memo on 4 July 2020, for re-affiliation of 599 govt-aided intermediate colleges in the state. He said that earlier under clause 39(2) of the Intermediate Council Act, affiliation was provide to intermediate colleges after the inquiry report of all intermediate colleges. On which the state govt had also provide its consent. Not only this, the govt was giving government assistance to all affiliated intermediate colleges. In 2013, govt funds were provide on the basis of the performance of the students but suddenly the board issued a direction to these colleges to take affiliation again. Also directed to submit inspection fee for taking affiliation.

He told the court that not a single candidate is being sent to take admission in Intermediate in colleges which have not submitted the inspection fee for seeking re-affiliation. Due to which intermediate colleges or institutes are on the verge of closure. He said that when the govt has given affiliation then why should the affiliation be taken again & again.

Bihar Board argued for better education


The court was told on behalf of the board that the govt is doing all this for the students to get education in colleges with better resources. There are many such intermediate colleges in the state which don't have any. The court while rejecting every argument provide by the board, set aside the instructions issued by the board, giving freedom to the colleges/institutes to inspect under section 19 of the board.

Name of Colleges/Institutes will be included on OFSS


Ganesh Prasad Singh which are General Secretary of the federation said that 599 Inter Colleges had been instructed by the Bihar Board to take affiliation. In these, the names of 138 colleges were removed from the OFSS portal. Such colleges will benefit after the Patna High Court's decision.
