Latest Updated 30/04/2024: The way has been cleared for the reinstatement of ANM on 10,709 posts in the state. Patna High Court on Monday rejected the state government's appeal, refusing to interfere in the single bench's decision to reinstate ANM on the basis of marks.
After hearing all the cases together on 18 April, the court had reserved its decision.
The division bench of Chief Justice Justice K Vinod Chandran and Justice Harish Kumar had reserved its order on 18 April after hearing all the cases together. It is noteworthy that on 1 March, the single bench of the High Court had ordered the reinstatement of ANM on the basis of marks. In a 69-page order, a single bench of Justice Mohit Kumar Shah had quashed the Bihar Technical Service Commission's notice dated September 19, 2023. The court said that the reinstatement of ANM will be done only under Rule 7 of Bihar Women Health Worker (ANM) Cadre Rules 2018.

Instructions were given to conduct written examination. In the light of the earlier order given by the High Court for the reinstatement of ANM, the government had published advertisement number 07/2022 for reinstatement on 10,709 posts of ANM. After this the selection process was started on the basis of ANM Rules 2018. Meanwhile, the state government amended the rules and released a notice for recruitment on the basis of written examination. The validity of this notice was challenged in the High Court. The court heard all the cases together.
The responsibility of the examination was given to Bihar Technical Service Commission.
The petitioner's lawyer told the court that the marks for this reinstatement of ANM were fixed by the government. Under this, 60 marks were fixed for ANM course examination, 15 marks for higher course and 5 marks (maximum 25 marks) for each year of working in a government hospital of the state. But the state govt modified this recruitment rule in the middle of the recruitment. According to this, 60 marks were fixed for competitive examination, 15 marks for higher course and 5 marks (maximum 25 marks) for each year of experience of working in a state government hospital. The responsibility of organizing the written examination was given to Bihar Technical Service Commission.

Court rejected the appeal of Bihar government
The single bench said in the order that the reinstatement of ANM will be done only under Rule 7 of the old rules 2018 and ordered to prepare the final merit list on the basis of marks under the old rules. This decision of the single bench was challenged by the state government by filing an appeal. The state government said that the government has the right to amend the reinstatement rules. The lawyer of the ANM candidates said that amendments cannot be made in the middle of the reinstatement process. The court rejected the appeal, rejecting the arguments given by the government. After this decision of the High Court, the way has been cleared for restoration of 10,709 posts of NNM under the old rules.
