High Court rejected the petitions filed in 69000 teacher recruitment case

Latest Updated 02/03/2024: Allahabad High Court has rejected the petition filed demanding implementation of EWS (Economically Backward Class) reservation in 69000 assistant teacher recruitment. The court said that the process of recruitment examination had started before the implementation of EWS reservation in Uttar Pradesh, in such a situation the state government is not legally bound to implement the reservation merely on the basis of issuing office memorandum. Justice Saurabh Shyam Shamsheri has given this order while hearing the petitions of Shivam Pandey and dozens of other petitions.

Dozens of economically backward candidates of general category involved in the recruitment of 69000 assistant teachers had filed a petition demanding implementation of EWS reservation in the recruitment process. It was said that the MP has made a provision of 10 percent reservation for economically backward people by the 103rd amendment to the Constitution on 12 January 2019.

The UP government implemented it by issuing an office memorandum on 18 February 2019. The process of recruitment of 69000 assistant teachers started on December 1, 2018, but the teacher recruitment examination was conducted in 2019 after the implementation of the Office Memorandum and its result was declared on May 12, 2020. The petitioner was successful in the examination, obtained the certificate of Economically Backward Class and presented it for implementation of reservation on 10 percent posts, but the government did not accept it due to which the petitioner could not be appointed.


The counsel for the petitioners in the case said that EWS reservation should be implemented in the recruitment examination because the examination and selection process has been done after the implementation of the amendment and the office memorandum implemented on 18 February 2019 regarding the EWS provision.
