Latest Updated 25/04/2023:  Jharkhand High Court will hear the petition challenging the State Constable Recruitment Rules, 2014 on 19 June. On Monday, the court was told on behalf of the successful candidates that a similar case related to Bihar is pending before the full bench of the Supreme Court. It should be heard in the High Court only after the hearing in the Supreme Court is over.


Accepting the request of the applicants, the court of Chief Justice Sanjay Kumar Mishra and Justice Anand Sen fixed the next date of hearing on 19 June. About 60 petitions have been filed in the Jharkhand High Court challenging the appointment rules. During the hearing, several advocates appearing for the applicant said that when the rules for the appointment of constables are mentioned in the police manual, there is no need for the government to frame separate rules.

Debate on the provision of separate examination It was said on behalf of the applicants that there is already a provision for the appointment of constables for Home Guards, in such a situation there should not be a provision for separate examination. The government has made provision for this in the rules, which is wrong, so the rules should be cancelled. On behalf of the government, the court was told that it is not mentioned in the police manual that the government cannot make recruitment rules. The government wants better candidates to join the constable, that is why provision for examination has been made in the rules.

In the petition, the former civil surgeon has been accused of registering 27 ultrasound clinics in violation of the rules. Only the Deputy Commissioner has the right of registration. The civil surgeon authorized 52 hospitals for Ayushman Bharat without forming a committee and without site verification. Not only this, the then Civil Surgeon has made the appointment ignoring the rules. In the appointment, where there should be science candidates, arts candidates were also appointed.
