High court strict in case of grant on the basis of fake documents

Grant of 609 madrassas stopped till investigation

Latest Updated 25/01/2023: About 2 and a 1/2 thousand madrassas of Bihar will be investigated. After 29 November 1980, the Patna High Court has ordered the Additional Chief Secretary of the Education Department to investigate 2459 madrassas funded by the state govt. The High Court immediately held a meeting with all the DMs and asked them to check their resources. He also ordered not to give grants to 609 madrasas till the investigation is completed. Along with this, in relation to the FIR registered regarding the recognition given to Madrasas on forged documents, the DGP was also ordered to give the full details of the investigation to the court.


On Tuesday, the bench of Chief Justice Justice Sanjay Karol and Partha Sarathi, Mo. of Sitamarhi. Gave this order on the application of Alauddin Bismil. Applicant's advocate Rashid Izhar said that on the basis of fake documents, grants are being given to open madrasas as well. On this, the court ordered an inquiry into 2459 madrasas.

  • Madrasas taking grants from 1980 will be investigated

What is the matter? The petitioner's advocate told the court that the Special Director of Secondary Education Mohd. Tasnimur Rahman has provide the investigation report of Sitamarhi's madrasas taking govt grants. It was said that about 88 madrassas have taken grant on fake documents. Told to take action by registering an FIR against them. Additional Chief Secretary of the Education Department, Deepak Kumar Singh, has given a reply affidavit in the High Court that a three-member committee has been formed to investigate 609 madrassas in other districts that receive government grants. 

The committee visited Khagaria, Banka, Begusarai, Katihar, Madhubani, Muzaffarpur, Kishanganj, Sheohar, Siwan, Bhagalpur, East Champaran, Patna, Purnia, West Champaran, Rohtas, Sheikhpura, Saharsa, Samastipur, Sitamarhi, Saran, Supaul, Darbhanga, Vaishali Araria Instructed to investigate madrasas in Aurangabad, Gaya & Gopalganj districts. The Additional Chief Secretary also gave reminders to the DMs of these districts for not sending the inquiry report within the stipulated time. But, the report came only from Sitamarhi. In this, the report of cancellation of grant of 88 madrasas has been given. On this, the Patna High Court ordered an inquiry into 2459 madrasas.


● DGP has also been ordered to give complete information about the research to the court.
● After holding a meeting with all the District Magistrates, he was asked to scrutinize the resources of Madrassas.


Children's education should not be interrupted under any circumstances, High Court


The High Court observed that every child up to a particular age has a constitutional and statutory right to be educated. Therefore, it will be ensured that the education of the children is not affected by the closure of any institution and they are admitted in any Government or other educational institution close to the place of residence of the child. The next hearing on the matter will be on February 14.


Action will also be taken against the culpable officers


The High Court ordered the chairman of a three-member committee to investigate the madrassas within four weeks. The DGP was ordered to file an affidavit from his own level regarding the registered FIR. In the investigation of grants given to fake madrasas, the court asked to take legal action against the madrasas including the guilty officials. Along with this, the court ordered a detailed investigation of other aspects including their resources under the Madrasa Act.
