The Supreme Court has set aside the order of the Jharkhand High Court to release the revised merit list of 6th JPSC. The court of Justice Ajay Rastogi and Justice Abhay S Oga gave this verdict on Thursday. After completing the hearing of the case, on 28 July, the court had reserved the verdict. The officers who were out of the revised merit list had filed an SLP in the Supreme Court against the order of the High Court. It was said on their behalf that it is correct to add the marks of Paper-I (Hindi and English) to the total score. These are qualifying papers. JPSC has not imposed the situation of securing minimum marks in any paper other than Paper-I. JPSC had put this situation in the advertisement and the first merit list was issued under this rule only. Considering the arguments, the Supreme Court set aside the order of issuing the revised merit list.

What was the matter after the 6th Civil Services Examination, the merit list of 326 candidates was issued. They were also appointed. Meanwhile the merit list was challenged in the High Court. The High Court canceled the merit list and ordered the release of the revised merit list. After this, the students who were out of the list reached the Supreme Court. The order of the High Court was challenged by filing the SLP.


It is not the fault of the officers who have been working for two years

While giving relief to 60 officers of 6th JPSC, the Supreme Court has said in its order that they have been working for two years. He has also completed his period of probation. Whatever rules were framed belonged to the government and JPSC. It was not the fault of the applicants, but these candidates were affected by the order of the High Court. The High Court gave the decision keeping in mind only the sixth JPSC and two sections of the provisions, which these candidates have to suffer. Now that the government has taken the seventh JPSC examination and has also prepared new rules. As such, it has to be seen in a broader perspective. In such a situation, the request of the petitioners has been accepted as not considering the order of the High Court.

Meanwhile the merit list was challenged in the Jharkhand High Court. The single bench of the High Court had directed to issue the revised list, stating that the merit list was wrong. Against this order, the successful candidates had appealed in the division bench. The division bench had also ordered the JPSC to issue the revised merit list, justifying the order of the single bench.


After this order, JPSC released the revised list. In the revised list, 60 such candidates were left out, who were appointed in various departments. Instead of them, the names of 60 other candidates were included in the list. The excluded candidates had challenged the order of the High Court by filing an SLP in the Supreme Court.


The government had said that adjustment of the excluded people is not possible, during the hearing, the Supreme Court had asked the government whether it would accommodate the candidates who were excluded from the revised merit list or not. Government has any such provision or not. On this, it was said from the government that it cannot adjust them nor is there any provision.


Appointment of candidates not included in the revised list After the release of the revised list of JPSC, the government has not appointed 60 new candidates who joined. After the SLP was filed in the Supreme Court, the court had stayed the order of the High Court and directed to maintain the status quo.
